The alternative public policy proposal „Strengthening the social status of the artist, author, creator in Romania”, formulated within the project "Alternative Culture" does not represent the official position of the Flower Power Cultural Association, the European Union or the funding authority - the Operational Program Administrative Capacity, being one of the results of the project "Alternative Culture" and the activities planned and carried out within it.
We invite you to the presentation of the public policy proposal „Strengthening the social status of the artist, author, creator in Romania” and the project that generated it: "Alternative Culture".
The project is run by Flower Power Cultural Association and is intended for the relevant individuals and entities in the cultural field to strengthen their capacity to initiate cultural public policies with the specific objective of formulating an alternative proposal to public policies leading to the improvement of the Artist Statute. The project is co - financed from European Social Fund, through The Operational program Administrative Capacity and is running from April 2018 to September 2019.
The first outline of this public policy, in the format of HG 775/2005, was formulated on a number of chapters by a group of 20 people in the expanded cultural field at a training camp in January 2019, taking into account valuable feedback on issues and the possible solutions, either sectorial or systemic, gathered through different types of instruments produced within the project in 2018: 1 online perception questionnaire (300 respondents), 9 debates in the country (191 participants) and 5 workshops with artists in the country (100 people). Subsequently, proposals for resolutions were added within a 17 întâlniri de lucru cu 55 de specialiști și stakeholderi.
In addition to local and international studies, legislative research on a mix of fish was used 120 Romanian laws, with the direct and connected address to the artist and the cultural environment, and analyzes created within the project. The current version of this public policy, subject to public consultation, is prepared by a group of experts attracted by the project. After the consultation, a series of strategic meetings with representatives of the competent public authorities will be initiated to complete the legislative circuit necessary for the presentation and favorable approval of public policy on Strengthening a socio-professional status of the artist, author, creator in Romania.
As an international context, UNESCO documents made in the direction of an Artist Statute were considered.
UNESCO recommendation on Artist Status from the 21 meeting in Belgrade, 23.09-28.10.1980 and the 2015 Analytical Report on the implementation of the UNESCO recommendation on Artist Status from 1980 (the most recent one being prepared for November 2019),
European Parliament resolution of 7 June 2007 on the social status of artists and Directive 2014/26 / EU of the European Parliament and of the Council of 26 February 2014 on the collective management of copyright and related rights, transposed into Romanian law until 30.03 .2019.
In Romania, for this PPP we have placed ourselves in the reference framework of Strategy for National Culture and Heritage 2016-2022, which, although not adopted, remains a key national document on the extensive cultural field. Applied to the public policy at issue in Strategy is one of the general objectives, which mentions the improvement of socio-professional status and the condition of the creator as a strategic point.
The identification of the legislative, social and professional elements regarding the status of the artist in Romania was possible due to a broad view on the issues of the extended cultural sector as well as of other societal sections (economic, legislative, social, etc.), through the studies in the project mentioned below and by consulting other documents such as strategies, analyzes, etc. Thus, the need for better social protection of the artist or of certain facilities and rights recognized and/or granted to the artist have found possible solutions to systemic level by reducing the level of chronic under-information of artists and cultural workers and clarifications due to proposals for legislative norms of associative structures representative of the extended cultural sector.
The solution of some (legal, social, professional) or "guild" difficulties is proposed through several key legislative and administrative solutions that, applied, decongest multiple financial areas that can provide sustainability to the expanded cultural sector. Also, consideration was taken of the condition of the artist as a whole (society), of the artist in the extended sense (by adding creator and author and definitions and normative proposals) and the artist as an individual and professional represented in his/her interests by professional associations (called in this PPP creation unions / creator associations / creator organizations and proposed to legislate).
